Terms of Service
The contract between you and Scaleify: accounts, plans, credits, Scout, liability and governing law.

Needs legal review: These terms describe how Scaleify actually operates, but the liability cap, consumer-rights carve-outs and the company details below must be confirmed by a qualified UK solicitor before launch.
1. Acceptance
These terms form a contract between you and Scaleify LTD (trading as Scaleify, operated by NextRank Marketing). By creating an account or using the platform you accept these terms, the Acceptable Use Policy, the Subscription & Billing Terms and the Refund & Cancellation Policy, each of which is part of this contract. If you do not accept them, do not use Scaleify.
2. Eligibility
You must be at least 18 and able to form a binding contract. If you sign up for an organisation you confirm you are authorised to bind it. Scaleify is intended for business use; where you are acting as a consumer, nothing in these terms removes rights you cannot lawfully waive.
3. Accounts and security
Provide accurate details and keep them current. You are responsible for everything done under your login, including by team members you invite and by anything using an API key you generate. Keep credentials and API keys confidential and tell us promptly at /contact if you suspect unauthorised access. Each workspace is isolated; do not attempt to access another workspace's data.
4. Free and paid plans
Scaleify offers a Free plan and paid plans (currently Starter, Pro, Elite and business/enterprise tiers). Each plan includes a monthly credit allowance and feature entitlements shown on our pricing page, which is the current statement of what each plan includes.
- Scout is available on every plan, including Free. Plans differ in how many Scouts you can keep configured and in other feature entitlements, not in whether Scout exists.
- Some capabilities — for example advanced search filters, advanced reporting, automations, team workspaces and API access — are limited to specific plans and are enforced server-side.
- Plan contents, limits and prices may change; see sections 13 and 19 and the Billing Terms.
5. Credits
Credits are the internal unit used to meter chargeable operations. They are a licence to use platform functionality, not money, not a stored-value instrument and not transferable between accounts or users outside your own workspace.
- Your plan grants a monthly credit allowance; you can also buy credit packs where available.
- One Scout search currently consumes 5 credits, charged server-side once the search has run successfully. Manual Find Opportunity searches, opportunity analysis, message generation and certain premium AI operations consume credits at the rates shown in the product at the time you run them.
- If a Scout search returns no usable opportunities, or fails, the charge is not applied or is refunded to your balance automatically. Repeating an identical request is protected against double-charging.
- If you do not have enough credits, the operation is refused before any work is done and you are prompted to top up or upgrade.
- Credits do not currently carry an expiry date applied by the platform. Monthly allowances are granted per billing period and we do not guarantee that an unused monthly allowance carries forward.
- Credits are consumed as the service is delivered and are not redeemable for cash. Refunds for purchased credits are dealt with in the Refund & Cancellation Policy.
- When an account is cancelled or closed, remaining credits cease to be usable at the end of the paid period and are not paid out.
Current credit rates are displayed in the product and may be adjusted; we will not retrospectively re-charge completed operations.
6. Scout and Find Opportunity — accuracy limits
These limits are important and you accept them by using the product:
- Results are drawn from permitted public sources and may be inaccurate, incomplete or out of date.
- An "opportunity" means our systems found publicly available evidence suggesting possible interest. It is not confirmation that a person or business wants to buy anything from you.
- Intent scores, evidence extracts and contact details are automated estimates you must verify.
- You must not represent to a prospect that they are actively seeking a service unless the evidence shown genuinely supports that, and you must not imply that Scaleify endorses your outreach.
- We make no guarantee of any number of opportunities, replies, leads, customers, sales, revenue or conversions. Nothing in the product is a forecast or a promise of commercial results.
- Source availability varies. If a search provider is unavailable or unconfigured, results may be reduced; where a search produces nothing usable we tell you honestly rather than filling the page.
7. Outreach responsibilities
Finding an opportunity does not give you permission to contact anyone. You are solely responsible for complying with applicable law and third-party rules when you make contact, including UK GDPR and the Privacy and Electronic Communications Regulations, anti-spam and electronic-marketing rules in the recipient's country, advertising and consumer-protection law, and the terms of any platform you contact someone on. Details are in the Acceptable Use Policy.
8. AI-generated output
Scaleify uses AI models to score opportunities, extract evidence and contact details, and draft messages, including the Scaleify AI assistant. AI output may be inaccurate or fabricated, must be independently verified before use, and is not professional, legal, financial or regulatory advice. You remain responsible for anything you send or decide. Models, prompts and behaviour may change over time as we improve the product. Do not submit data you are not permitted to share with an AI processor.
9. Ad campaign services
Scaleify's ad-campaign feature lets you brief a paid advertising campaign, upload creative and receive an indicative quote. Quotes are estimates based on your brief and are not binding until confirmed and paid. Promotional codes apply only as stated at checkout and may be withdrawn. Delivery of campaign services is provided by NextRank Marketing. You warrant you own or are licensed to use any creative you upload, and that your advertising complies with applicable advertising law and platform policies. Advertising outcomes are not guaranteed.
10. Acceptable use
The Acceptable Use Policy sets out prohibited conduct including spam, harassment, fraud, scraping private data, circumventing credit limits or plan restrictions, and interfering with the platform. Breach may lead to suspension or termination.
11. Your content and intellectual property
You keep ownership of the business information, prospect records, messages, files and creative you put into Scaleify. You grant us a licence to host, process and display that content solely to operate the service for you. Scaleify's software, interfaces, branding and design remain owned by us and our licensors; nothing here transfers them to you. You may use outputs generated for your workspace in your own business, but you may not resell, redistribute or systematically extract platform results as a competing dataset or service.
12. Third-party services
Scaleify depends on third parties including hosting and database infrastructure, an AI gateway routing to third-party models, public-web search APIs, an optional Google sign-in, a payment processor and an email provider. Their availability, terms and results are outside our control, and we are not responsible for third-party services you connect to or contact through.
13. Availability and changes to the service
We aim for a reliable service but do not commit to a specific uptime level unless separately agreed in writing. Planned maintenance, emergency fixes and provider outages may interrupt access. We may add, change or remove features, and may change credit rates or plan limits prospectively, giving reasonable notice of materially adverse changes to paying customers.
14. Suspension and termination
We may suspend or terminate access where you breach these terms or the Acceptable Use Policy, where payment fails, where use threatens platform security or a third-party relationship, or where required by law. Where practical we give notice and an opportunity to fix the problem; serious cases may be immediate. You may close your account at any time. On termination your right to use the platform ends and workspace data is deleted or anonymised in line with the Privacy Policy.
15. Payment, tax and refunds
Subscriptions are billed in advance through our payment processor. Prices are shown in pounds sterling and, unless stated otherwise, exclude any VAT or other tax that must be added, which is applied at checkout where applicable. Cancellation and refunds are governed by the Refund & Cancellation Policy and the Subscription & Billing Terms.
16. Disclaimers
Except as expressly stated, the platform is provided "as is" and we exclude all implied warranties to the extent the law allows, including fitness for a particular purpose and that results will be accurate, complete, uninterrupted or error free. We do not warrant any commercial outcome.
17. Limitation of liability
Nothing limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be limited — including consumers' statutory rights. Subject to that, we are not liable for loss of profit, revenue, business, goodwill, anticipated savings, or indirect or consequential loss; and our total liability arising in any twelve-month period is limited to the amount you paid us for the service in that period.
Needs legal review: The liability cap and its interaction with consumer rights for sole traders and individuals must be reviewed before launch.
18. Indemnity
If you use Scaleify in breach of these terms or the Acceptable Use Policy — for example unlawful outreach, infringing creative, or unlawful processing of someone's personal data — you agree to indemnify us against third-party claims, losses and reasonable costs arising from that use. This does not apply to consumers to the extent it would be unenforceable.
19. Changes to these terms
We may update these terms. The version number and dates at the top of this page always reflect the current text. Material changes are notified to account holders in advance where reasonably possible; continuing to use Scaleify after they take effect means you accept them.
20. Governing law, jurisdiction and contact
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction, save that consumers may bring proceedings in their own place of residence where the law allows.
